Rep. Earl L. “Buddy” Carter (R-Georgia) launched the PBM Reform Act final week, which seeks to crack down on pharmacy profit supervisor (PBM) practices.

The invoice has bipartisan assist and was co-sponsored by Representatives Debbie Dingell (D-Michigan), Greg Murphy (R-North Carolina), Deborah Ross (D-North Carolina), Jodey Arrington (R-Texas), Diana Harshbarger (R-Tennessee), Vicente Gonzalez (D-Texas), Rick Allen (R-Georgia), Raja Krishnamoorthi (D-Illinois), John Rose (R-Tennessee), Derek Tran (D-California), and Nicole Malliotakis (R-New York).

The invoice will ban unfold pricing in Medicaid. That is when a PBM prices payers greater than they pay the pharmacy for a drugs after which retains the distinction as revenue. It additionally seeks to “delink” PBM compensation from the price of medicines beneath Medicare Half D.

As well as, it’ll require semi-annual reporting on drug spending, rebates and formulary determinations. It’ll additionally mandate that the Facilities for Medicare and Medicaid Companies implement “cheap and related” contract phrases in Medicare Half D pharmacy contracts and handle violations.

The introduction of the invoice comes as the large three PBMs — CVS Caremark, UnitedHealth Group’s Optum Rx and Cigna’s Specific Scripts — management 80% of the prescription drug market.

“It’s time to bust up the PBM monopoly, which has been stealing hope and well being from sufferers for many years. As a pharmacist, I’ve seen how PBMs abuse sufferers firsthand, and consider that the treatment to this infectious illness is transparency, competitors, and accountability, which is precisely what our bipartisan bundle gives,” Carter stated in a press release.

Carter’s feedback have been echoed by Dingell of Michigan.

“For too lengthy, pharmacy profit managers have been allowed to function unchecked, elevating costs and stopping many sufferers from getting the medicines they rely on,” Dingell stated in a press release. “I hear from too many Michiganders, particularly seniors, who can’t conveniently entry the prescriptions they want, as a result of exploitative PBM practices complicating entry to their native pharmacies. Their dangerous, aggressive ways are solely getting worse, and we should take motion now to guard pharmacies and decrease affected person prices. I stay dedicated to working with my colleagues on either side of the aisle to get this throughout the end line.”

Quite a few different efforts have been taken focusing on PBMs. The state of Arkansas lately created a legislation banning PBMs from proudly owning and working pharmacies within the state, prompting CVS Caremark and Specific Scripts to file separate lawsuits difficult the legislation.
